महँगी पड़ी गोंडा मामले में कोर्ट के आदेश की अवहेलना, बेसिक शिक्षा निदेशक दिनेश बाबू को कोर्ट ने किया तलब
लखनऊ -एक तो विभाग में फर्जी नियुक्तियों की भरमार उसको रोक पाने में पूरी तरह से नाकाम रहे निदेशक बेसिक शिक्षा दिनेश बाबू शर्मा कोर्ट के आदेश में भी लापरवाही बरती और 2 हफ्ते में गोंडा के सहायता प्राप्त विद्यालयों में बिना किसी नियम कानून का पालन कर विभाग से सम्बंधित और बेरोजगारों को गुमराह कर अनियमित रूप से की गयी नियुक्ति की जांच के लिए है कोर्ट की लखनऊ बेंच में अनिल कुमार द्वारा याचिका दायर की गई थी जिस पर कोर्ट ने आदेश पारित करते हुए निदेशक बेसिक शिक्षा को सारे प्रकरण की सुनवाई करते हुए कार्यवाही का निर्देश दिया था यह प्रक्रिया उन्हें 2 हफ्ते में पूरी करनी थी लेकिन 2 महीने से ज्यादा बीत जाने के बाद भी वह पूरी तरह से नाकाम रहे जिस पर याची ने कोर्ट के आदेश की अवमानना की याचिका दायर की जिस पर कोर्ट ने निदेशक दिनेश बाबू को 17 नवम्बर को व्यक्तिगत रूप से हाजिर होने का निर्देश दिया है और यदि कोर्ट के आदेश का अनुपालन कर लिया जाता है तो उन्हें कोर्ट में शपथ पत्र दाखिल करना होगा । बताते चले कि जनपद गोंडा में सहायता प्राप्त विद्यालयों में पूरी तरह से अराजकता बरतते हुए मनमाने ढंग से नियुक्ति की जाती है जिसमे न ही विज्ञापन और न ही अनुमोदन की सही ढंग से प्रक्रिया अपनाई जाती है और इस सारे खेल को संगठित गिरोह द्वारा पुरे प्लान के तहत अंजाम दिया जाता है जिसमे विभाग के कुछ लोगों कि भी पूरी संलिप्तता होती है गोंडा जनपद के इस विभाग कि स्थिति इतनी बदतर है कि कई वर्षों का डिस्पैच रजिस्टर तक गायब है लेकिन विभाग ने इस मामले में कोई कार्यवाही नहीं कि है जनपद में संगठित गिरोह द्वारा सामानांतर विभाग चलाया जा रहा है इस काकस के आगे विभाग ने घुटने टेक रखे हैं और जो भी इस काकस का विरोध करता है उसे अधिकारीयों द्वारा अपने पद का दुरूपयोग करते हुए झूठी रिपोर्ट चाहे शासन हो या फिर कोर्ट वहां भेजी जाती है । यदि इस मामले में सही तरीके से कार्यवाही हुई तो कई लोगों के नापने की पूरी उम्मीद है और विभाग के ही चहेते लोगों द्वारा अनियमित तरीके से हथियाये गए पद भी खाली हो सकते है जिससे योग्य बेरोजगारों के लिए रास्ते खुल सकते हैं । क्या है अवमानना कोर्ट का आदेश Court No. - 24 Case :- CONTEMPT No. - 2065 of 2015 Applicant :- Anil Kumar Opposite Party :- Mr. Dinesh Babu Sharma, Dir. Petitioner has filed instant contempt petition alleging willful non compliance of the order dated 30.6.2015 passed in Writ Petition No.5606 (M/B) of 2015 ((Anil Kumar vs. State of U.P. & ors) whereby the writ court while disposing of the writ petition gave liberty to the petitioner to make representation, ventilating all his grievances, supported by such documents, as may be advised, before Director of Education (Basic) U.P. Lucknow within four weeks alongwith the certified copy of the order and the Director of Education (Basic) was required to consider and decide the same in accordance with law by means of speaking and reasoned order preferably within two weeks from the date representation is made after affording opportunity of hearing to the parties concerned. Learned counsel for the petitioner further submitted that the copy of the order of the writ court was served through post to the opposite party on 25.7.2015. Petitioner was issued notice on 3.8.2015 to appear before the Director of Education (Basic) on 10.8.2015 at 12:30 p.m. He next submitted that petitioner appeared on the date fixed where another date of 20.8.2015 was fixed for hearing. Petitioner submitted his written submission before the Director one day before i.e. 19.8.2015. He also submitted that on 20.8.2015 nothing was done in the matter and even no date has been fixed. The grievance of the petitioner is that time allotted by the court has also expired and till date no action has been taken in compliance of the order of the writ court, therefore, the petitioner has approached this Court by way of this petition for seeking action against the opposite party for willful non compliance of the order of the writ court. After considering the submissions of the petitioner and perusal of record, prima-facie a case for contempt is made out. Issue notice to opposite party fixing 17.11.2015. On that date opposite party shall appear in person before this court to show cause as to why proceedings under the Contempt of Court's Act may not be initiated for willful disobedience of the aforesaid order. It is clarified, that if the order of the writ court is complied with in its true spirit before the date fixed, the opposite party need not appear on the date fixed and shall file only an affidavit of compliance of the order. Counsel for the petitioner is directed to furnish a copy of the petition to Standing Counsel, who shall transmit the same to the opposite party alongwith gist of order at the earliest.
